Terms of Service

1. Agreement

LowOne ("LowOne", "we", "us") is a strategy game that runs in your browser and settles on the Solana blockchain. Playing a round requires a stake.

These Terms of Service ("Terms") form a binding agreement between you and the operator of LowOne.

They govern your use of the website at lowone.app, the LowOne game interface, the on-chain program FhppJXUo12wvMnbUfFhgxP6cZWaksJx3WncEX5mcv2qJ, and our chat and community features (together, the "Service").

By ticking "I agree" and using the Service, you accept these Terms. If you do not accept them, do not use the Service.

2. What LowOne is, and is not

2.1 The game

Participants privately select one number from a fixed set. When the round closes, the number selected by the fewest participants wins.

2.2 Stakes and prizes

Playing a round requires a stake, and you can lose it.

When you join a round, the stake moves from your wallet into an on-chain escrow program. Every participant's stake forms the pot. When the round resolves, the pot is paid to whoever selected the winning number, less our fee (Section 12). Everyone else loses their stake.

If a round is cancelled, every stake is returned in full.

We never hold your stake. It is held by the on-chain program from the moment you join, and it can leave that program in only two ways: paid to a winner, or refunded to you. See Section 6.

2.3 This may be regulated where you live

Playing involves committing money to an outcome you do not control, for the chance to win more. Activities of this kind are regulated, restricted, or prohibited in many countries and regions, and the rules differ widely.

We make no claim that the Service is lawful where you are. Establishing that is your responsibility, and Section 5 applies. If you are in any doubt, do not play.

2.4 Not a financial service

We are not a broker, exchange, custodian, payment institution, e-money institution, virtual currency service provider, investment firm, or credit institution. We do not transmit value, execute transactions on your behalf, or offer investment products.

We do not take custody of your stake. It moves from your wallet directly into the on-chain program, which pays winners and issues refunds under rules published in its code. We hold no account balance for you and cannot move your stake to anyone but you or the round's winner.

We do not give financial, investment, tax, or legal advice.

2.5 No token

We have not issued a token. We have not promised, committed to, or scheduled one.

Any token claiming affiliation with LowOne is not ours. We have no control over it and accept no responsibility for it. If we ever issue one, it will be announced only through the official channels in Section 17, and these Terms will be updated first.

Nothing on the Service is an offer of, or solicitation to acquire, any financial instrument, transferable security, or crypto-asset within the meaning of Regulation (EU) 2023/1114 (MiCA) or Directive 2014/65/EU (MiFID II).

3. Eligibility

To use the Service you must:

  • be at least 18 years old
  • have legal capacity to enter into a contract
  • not be a Restricted Person under Section 5
  • not be barred from using the Service under applicable law
  • not have been previously removed from the Service

If you use the Service for an organisation, you confirm you are authorised to bind it.

4. Age

We do not currently verify age and rely on your representation that you are 18 or over.

If we learn a user is under 18, we will close the account and delete the associated personal data.

5. Restricted persons and jurisdictions

5.1 Your representations

You represent and warrant that you are not:

  • resident in, located in, or a national or agent of any jurisdiction subject to comprehensive sanctions by the EU, UN, UK, or the US Office of Foreign Assets Control. These currently include Cuba, Iran, North Korea, Syria, Russia, Belarus, and the Crimea, Donetsk, Luhansk, Kherson and Zaporizhzhia regions of Ukraine
  • listed on the EU Consolidated Sanctions List, the OFAC Specially Designated Nationals List, the UK Sanctions List, or any comparable list
  • owned or controlled by, or acting on behalf of, any such person
  • located where use of the Service would be unlawful

5.2 Our rights

We may restrict access by geography, IP address, wallet address, or any other signal, at our discretion and without notice. We may screen wallet addresses against sanctions and risk databases and refuse or terminate access accordingly.

Geographic restriction is imperfect. Circumventing it by VPN, proxy, misrepresentation or otherwise breaches these Terms and does not make your use lawful.

5.3 Your own compliance

You are responsible for determining whether your use of the Service is lawful where you are. We make no representation that the Service is appropriate or available in any particular location.

6. Wallets

6.1 Non-custodial

We never hold, control, or have access to your wallet, private keys, seed phrase, or assets. You connect a self-custodied Solana wallet and retain sole control at all times.

6.2 Your responsibility

You are solely responsible for securing your keys and seed phrase; all activity through your wallet, whether authorised by you or not; verifying every transaction before signing; selecting the correct network; and the security of your wallet software.

6.3 What we cannot do

We cannot recover lost keys or seed phrases, reverse a signed transaction, recover assets sent to a wrong address or network, freeze or restore a compromised wallet, or restore access to a wallet you no longer control.

These losses are permanent and irreversible.

6.4 Third-party wallets

Wallet software (Phantom, Solflare, and others) is provided by third parties under their own terms. We do not endorse, control, audit, or accept responsibility for it.

7. Blockchain risks

You acknowledge and accept the following.

7.1 Finality

Transactions confirmed on Solana are irreversible. No transaction can be cancelled, reversed, refunded, or modified by you, by us, or by anyone.

7.2 Network conditions

Solana is operated by independent validators outside our control. It may experience congestion, elevated fees, dropped or failed transactions, RPC failures, forks, reorganisations, degraded performance, or complete halts. Solana has halted before and may halt again.

Rounds may fail to start, fail to resolve, resolve late, or stall as a result.

7.3 Network fees

Solana charges a fee per transaction. You pay this to the network, not to us. We do not set it, receive it, or refund it. A failed transaction may still incur a fee.

7.4 Public and permanent

Everything written on-chain is public and permanent. Your wallet address, participation, revealed selections, and transaction history are visible to anyone, forever, and cannot be deleted or altered. That includes by us, and includes in response to an erasure request. See the Privacy Policy.

8. Smart contract risks

8.1 Software has defects

The on-chain program may contain bugs, vulnerabilities, or unexpected behaviour causing rounds to resolve incorrectly, fail to resolve, or behave contrary to this description.

8.2 Audit status

The program has not been independently audited.

An audit reduces risk. It does not eliminate it.

8.3 Emergency pause

The program includes an emergency pause we may activate on a suspected vulnerability, active exploit, critical malfunction, or threat to users or game integrity. While paused, no new rounds start and no new stakes are accepted. Stakes already in escrow stay there and remain claimable or refundable: the pause stops money entering, never money leaving.

8.4 Upgrade authority

Upgrade authority is held by a 2-of-3 multisig.

The program's behaviour can be changed by agreement of two of the three signers. LowOne is not immutable, and using it involves trusting those signers.

8.5 Operating key

Round lifecycle operations, meaning opening, locking, revealing and finalising, are triggered by an operating key held by our backend. The key is replaceable. Round progression is not autonomous: our servers drive it, and if our infrastructure fails, rounds may stall.

We state this plainly because decentralisation is easy to overclaim. The on-chain program enforces the rules and the tally. Our server drives the sequence.

9. Fairness and mechanics

9.1 Commit and reveal

Selections are hidden using a cryptographic commit/reveal scheme, so other participants cannot see your choice before reveal.

9.2 Salt handling

Reveal salts are generated in your browser and are not transmitted to our servers before the round closes. We cannot observe your selection in advance.

If your browser does not send the salt during the reveal window, your selection cannot be proven and is excluded from the round.

9.3 Tie-breaking

Where two or more numbers tie as least-picked, the tie is resolved on-chain using a recent block hash. The value is not predictable at the time selections are made.

9.4 Round parameters

Participant minimums and maximums, countdown durations, and entry cut-offs are shown in the interface and may change. Material changes are announced under Section 17.

10. Acceptable use

You may not:

  • use the Service unlawfully
  • create multiple accounts to distort outcomes, standings, or statistics
  • use bots, scripts, or automation to participate in rounds
  • collude with others to coordinate selections
  • exploit bugs. Report them to info@lowone.app
  • reverse engineer, decompile, or disassemble the Service, except to the extent this right cannot be excluded by law
  • attempt unauthorised access to any part of the Service
  • interfere with or disrupt the Service or its infrastructure
  • scrape or harvest data except as permitted by robots.txt
  • misrepresent your identity, age, or location
  • circumvent access restrictions
  • resell, sublicense, or commercially exploit the Service without written permission

11. Chat and user content

11.1 Your content

You retain ownership. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display your content for the purpose of operating the Service. The licence ends when you delete the content, except for backup copies and legally required retention.

You confirm you have the rights to what you post.

11.2 Prohibited content

Do not post content that is unlawful or promotes unlawful activity; harassing, abusive, or threatening; hateful or discriminatory; sexually explicit; sexual content involving minors in any form; violent or graphic; spam or unsolicited promotion; a scam or phishing attempt; promoting tokens, investments, or financial opportunities; infringing; disclosing another person's private information; impersonating another person; or malicious code.

11.3 Moderation

We may review, remove, or restrict content and suspend or terminate accounts. We are not obliged to monitor content and do not pre-screen it.

Notice and action. Report unlawful content to info@lowone.app or through in-app reporting. We will assess reports promptly and act where appropriate.

Statement of reasons. If we remove or restrict your content, we will tell you what was removed, why, the legal or contractual basis, and how to contest it.

Complaints. You may contest a decision by replying to our notice within 14 days. We will review it and respond within 14 days. Out-of-court dispute settlement bodies certified under Article 21 of Regulation (EU) 2022/2065 (the Digital Services Act) remain available to you, as does recourse to the courts.

11.4 Copyright

If you believe content on the Service infringes your copyright, contact info@lowone.app with identification of the work, the location of the allegedly infringing content, your contact details, and a statement of your good faith belief that the use is unauthorised. We remove infringing content and terminate repeat infringers.

12. Fees

We charge nothing to create an account, create a room, or use chat.

We take 3% of each pot. It is taken once, at settlement, from the pot before it is split. Nothing further is charged when you lose, and nothing is charged at all if a round is cancelled, in which case every stake is refunded in full.

The rate is capped at 10% in the on-chain program and cannot be set above that by anyone, including us. A round keeps the rate it opened with, so a change cannot affect a round already in progress.

Solana also charges a network transaction fee per transaction. You pay that to the network, not to us. We do not set it, receive it, or refund it. A failed transaction may still incur one.

Joining a round also requires a small on-chain account deposit, currently around 0.0016 SOL. This is returned to you when the round settles. It is a deposit, not a charge.

If our fee model changes, we will update these Terms and give notice under Section 17.

13. Intellectual property

The Service, including its name, logo, interface, design, text, graphics and software, is owned by us or our licensors.

We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes. All other rights reserved.

Feedback you send us may be used without restriction or compensation.

14. Liability

We are liable for damage caused intentionally or through gross negligence without limitation.

For slight negligence, we are liable only for breach of an obligation essential to the proper performance of this agreement and on which you may reasonably rely, and our liability is limited to the damage typically foreseeable for this kind of agreement.

We are not liable for: loss of your private keys or seed phrase; unauthorised access to your wallet; transactions you signed; blockchain network failure, congestion, or halt; third-party wallet or RPC failures; smart contract defects not attributable to our intent or gross negligence; content posted by other users; or your breach of these Terms.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury, for intent or gross negligence, or under applicable product liability law. Your statutory rights as a consumer are unaffected.

15. Term and termination

You may stop using the Service at any time and request account deletion under the Privacy Policy.

We may suspend or terminate your access for breach of these Terms, suspected unlawful or fraudulent activity, sanctions concerns, or to protect the Service or its users. Where practicable we will give notice and reasons.

Sections 6, 7, 8, 13, 14, 16, and 17 survive.

16. Changes and official channels

16.1 Changes

We may amend these Terms. Material changes take effect 30 days after we post the revised version with an updated date and notify you through the Service or by email.

Continued use after the effective date constitutes acceptance. If you do not accept, stop using the Service and delete your account. Where a change materially disadvantages you, you may terminate immediately.

16.2 Official channels

Treat anything else as fraudulent. We will never DM you first, ask for your seed phrase, ask you to sign a transaction to "verify" or "claim", or announce a token elsewhere.

17. Governing law and disputes

If you are a consumer, any choice of law will not deprive you of the protection of mandatory provisions of the law of your country of habitual residence, and you may bring proceedings in the courts of your country of residence.

18. General

Entire agreement. These Terms and the Privacy Policy are the entire agreement between us.

Severability. If a provision is invalid, the remainder stands and the invalid provision is replaced by the closest lawful equivalent.

No waiver. Failure to enforce is not a waiver.

Assignment. You may not assign these Terms. We may assign them on a merger, acquisition, or sale of assets, provided your rights are not reduced.

Force majeure. We are not liable for failure to perform due to causes beyond our reasonable control, including blockchain network failure, internet outages, natural disasters, or governmental action.

Language. These Terms are provided in English, which governs.

Notices. We may notify you through the Service or at any email you provide. Notices to us go to info@lowone.app.
